The Republic of Belarus approved the Rules for Access to Services for Operational Dispatch Management in the Electric Power Industry and the Rules for Access to Services for the Transmission and Distribution of Electricity
In pursuance of clause 6 of the Decree of the President of the Republic of Belarus No. 153 of April 16, 2021 "On the development of the electric power industry", the Council of Ministers of the Republic of Belarus on July 2, 2021 adopted Resolution No. 381 "On measures to implement the Decree of the President of the Republic of Belarus No. 153 "(hereinafter - Resolution No. 381).
Resolution No. 381:
1.approved:
- Rules of access to services for operational dispatch control in the electric power industry;
- Rules of access to services for transmission and (or) distribution of electric energy;
2.. changes are made to:
- Electricity supply rules approved by the Resolution of the Council of Ministers of the Republic of Belarus dated October 17, 2011 No. 1394;
- Regulation on the procedure for setting prices (tariffs) for natural and liquefied gas, electric and thermal energy, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated March 17, 2014 No. 222;
- a unified list of administrative procedures carried out by state bodies and other organizations in relation to legal entities and individual entrepreneurs, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated February 17, 2012 No. 156;
3. instructions were given:
- to the owners of block stations connected directly or indirectly to the power grids of power supply organizations that are part of the Belenergo State Production Association, and by December 1, 2021, to conclude contracts for the provision of services for operational dispatch control in the power industry by such power supply organizations,;
- republican government bodies and other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk City Executive Committee until October 21, 2021, bring their normative legal acts in line with Resolution No. 381 and take other measures to implement it.
In order to fulfill the specified order of the Government of the Republic of Belarus, it is envisaged that state bodies will accept:
• Ministry of Energy - a number of regulatory legal acts, including:
- Instruction on the procedure for planning and calculating costs for the provision of services for operational dispatch control in the electric power industry;
- Instruction on the procedure for planning and calculating costs for the provision of services for the distribution, transmission and distribution of electrical energy;
- forms of:
- departmental reporting on the volumes of production, transmission, distribution and sale of electric energy (for legal entities that own, manage or operate a block station);
- statements of intent to conclude an agreement for the provision of services for operational dispatch control in the electric power industry;
- statements of intention to conclude an agreement for the provision of services for the transmission and distribution of electrical energy and (or) an agreement for the provision of services for the distribution of electrical energy.
• The Ministry of Antimonopoly Regulation and Trade - a regulatory legal act that sets tariffs for services in the distribution of electrical energy, transmission and distribution of electrical energy, and operational dispatch management in the power industry.
• Regional executive committees and the Minsk City Executive Committee in agreement with the Ministry of Housing and Communal Services and the Ministry of Energy - decisions defining the lists of organizations whose property is in communal ownership, whose activities are controlled by structural units of local executive and administrative bodies exercising state and power powers in the field of housing and communal services (according to clause 292 of the Electricity Supply Rules as amended by Resolution No. 381).
Owners of block stations and consumers of electric energy, who are housing and communal services organizations, should be included in such lists in order to provide them with the opportunity to form contractual relations for the purchase and sale of electric energy within one region.
Thus, taking into account the provisions of Resolution No. 381:
- legal entities and individual entrepreneurs that are the owners of block stations must, in the period from October 21, 2021 to December 1, 2021, provide:
- Conclusion with power supply organizations that are part of the State Production Association "Belenergo", contracts for the provision of services for operational dispatch control in the electric power industry on the basis of applications submitted to the indicated power supply organizations by the owners of block stations in the form determined from October 21, 2021 by the resolution of the Ministry of Energy of the Republic Belarus dated January 29, 2016 No. 4 "On the establishment of forms of documents."
In accordance with the second part of clause 5 of the Rules for access to services for operational dispatch control in the electric power industry, in case the owner of a block station refuses to conclude an agreement for the provision of services for operational dispatch control in the electric power industry, the block station of such an owner must be disconnected from the power grid of power supply organization, which is part of the State Production Association "Belenergo", or another owner of the electrical network;
- Amendments to power supply agreements concluded with the power supply organizations that are part of the State Production Association Belenergo with the owner of the block station, or the renegotiation of such agreements due to changes in their essential conditions;
- legal entities that are the owners of block stations must, in 2022 and subsequent years, ensure the compilation and submission of departmental reporting data on the volumes of production, transmission, distribution and sale of electric energy to the energy supplying organizations that are part of the Belenergo State Production Association in a timely manner.
Also, Resolution No. 381 gives the status of mandatory to the following technical codes of established practice (through the establishment of a link to them in the Electricity Supply Rules):
- TCP 181-2009 (02230) "Rules for the technical operation of electrical installations of consumers", approved by the Resolution of the Ministry of Energy of the Republic of Belarus dated May 22, 2009 No. 16;
- TCP 387-2012 (02230) "Investigation and accounting of violations in the operation of energy facilities of consumers of electrical and (or) thermal energy", approved by the Resolution of the Ministry of Energy of the Republic of Belarus No. 106 dated May 30, 2012;
- TCP 460-2017 (33240) "The procedure for calculating the amount of technological consumption of electrical energy for its transmission through electrical networks, taken into account in financial calculations for electricity between the energy supplying organization and the consumer (subscriber)", approved by the decree of the Ministry of Energy of the Republic of Belarus dated June 22, 2017 . No. 19.
The main provisions of Decree No. 381 come into force simultaneously with the main provisions of the Decree of the President of the Republic of Belarus of April 16, 2021 No. 153 "On the development of the electric power industry" - from October 21, 2021.
